Wrong Diagnosis Leads to Unnecessary Surgery and Lawsuit

When we visit the doctor, we expect that he will properly diagnose the illness and provide the correct treatment. Unfortunately, this was not the case for a Chicago woman. The woman has filed a lawsuit in Cook County, alleging that her doctor wrongly diagnosed her condition, and as a result, underwent unnecessary hernia surgery. The lawsuit names Mercy Hospital and Medical Center in Chicago, Mercy IPA, and the doctor and is seeking a judgment of more than $50,000. Misdiagnosis Misdiagnosis, and other medical mistakes, occurs with alarming frequency. According to the CDC, medical mistakes are now the third leading cause of death in the United States. Medication errors, failure to diagnose, improper treatment, surgical errors, and mistakes by doctors, are among the most common problems. In this …

Sometimes you get bad advice even from the Social Security office

A friend of mine contacted me a few days ago. A long-time friend of hers was looking into filing for disability benefits. Actually, he had been considering filing for about three years, which was part of the problem (if your condition is severe enough that it makes it difficult for you to engage in and do work activity, "thinking" about applying for disability may simply amount to a very huge

Florida Supreme Court to hear medical malpractice case

The legal process can take a long time to fully play out. This does not diminish its importance, however. Instead, those cases that make it to the Florida Supreme Court’s level are bound to reshape the law as we know it. This can have a significant impact on Floridians, including those affected by medical malpractice. To see just how much of a difference it can make, one need only look to one case before the Supreme Court this month. In June, the Court will review a case and hear arguments on non-economic damages for personal injury medical malpractice cases. This is a hot-button issue, as in 2014 the Court held that there cannot be a limit on the amount of non-economic damages when medical malpractice …

Suit Filed for Man Injured in Chemical Plant Explosion

At Arnold & Itkin, we recognize both the danger and the necessity of industrial work. While we believe that plants explode far more often than they should, we know that working in manufacturing and chemical processing is a dangerous occupation by nature. That’s why, when workers are needlessly injured due to negligence, we fight so passionately on their behalf. The case our firm filed today is one such case. Our newest client was a victim of an explosion at a chemical plant in Pasadena, Texas. One of the factors that led to his injuries was a defective product, so we are holding the manufacturer of the product accountable for their poor manufacturing or design. Ultimately, this case is about doing what’s right. Our client was …

The Details Of Judge Curiel’s Trump University Orders

Popehat already explained in general why there’s nothing unusual about Judge Curiel’s rulings in the Trump University case, i.e., that denying summary judgment is the norm. Nonetheless, Kevin Drum recently mused: I think we all know perfectly well that Curiel is just an ordinary judge, and Trump is ranting against him because that’s what Trump does whenever something doesn’t go his way. He whines. Endlessly. Still, I’m kind of curious. It would be interesting if some kind of qualified lawyer type went through the records of these trials and reported back on whether Curiel seems to be conducting things fairly. Maybe he’s not! Maybe he really does hate Trump. Unfortunately, I suppose that would be a lot of work. Oh well. Let’s …

Clean air: a claim under Article 1?

In February 2013 nine-year-old Ella Kissi-Debrah from Hither Green in South London died after suffering a severe asthma attack. “Can the courts be used to establish that we have a human right to clean air?” asked Nick Robinson on the Today Programme this morning. A report by Royal College of Physicians has apparently linked 40,000 deaths to pollution each year. A successful case against the government would arguably put the government under considerable pressure as well as resulting in justice for affected families. Ella’s mother and her lawyer were interviewed on the programme. Ella had very severe asthma. According to the Today Programme, nitrogen dioxide levels around their home on the South Circular are double the EU legal limit. Her lawyer, Jocelyn Cockburn…

A Lawyers’ Listserv Gets SCOTUS Recognition

Sign inside the Supreme Court on Tuesday. It came as a shock to everyone in our informal listserv group that was sworn in on Tuesday to the Supreme Court bar. When we entered the building, we were asked what group we were from. Ummm, each of us stuttered, a group of trial lawyers from New York organized by Jay Breakstone? “You guys the Rogues?” Holy shit! The SCOTUS marshals and clerks knew the jokey name of our informal listserv!? No way! We were at first startled and flabbergasted, then astounded and amazed. Our little group of 28 New York personal injury lawyers, plaintiffs-side only, walked up the interior stairs of the Court, following those clerks and marshals, who all knew we were “the Rogues,…

The importance of Fire Safety Training

Fire safety training is essential to know especially when you review the recent statistics concerning fire. Some Important Fire-related Statistics Over the span of a year, from 2011 to 2012, local rescue services in Britain were called out to almost 585,000 fires or false alarms. Of these call-outs, approximately 272,000 were for actual fires whilst 312,000 were false alarms. Of the 70,000 building fires reported, approximately 44,000 took place in private dwellings. Of the primary fires recorded, around 6,000 took place in dwellings whilst 7,300 happened in other structures. About 14,000 of the fires involved a fire in a car. When you review the above statistics, fire safety training is not the kind of knowledge you can blithely sweep under a rug or scan over randomly. In order to reduce any risk of liability and …
