Fieldfisher influence Parliamentary debate on massive rise in court fees

Last week, Fieldfisher set out it’s response to Government proposals to increase court fees by as much as 600{9c067c25ed205f086ce6001901eb13dfadc688a7aefab9f64e0c55b8c5a55872}. A written statement made by the Minister for the Courts and Legal Aid on the 16th January made it clear that it was the Government’s intention to introduce a fee to commence proceedings for the recovery of money at 5{9c067c25ed205f086ce6001901eb13dfadc688a7aefab9f64e0c55b8c5a55872} of the claim value for claims worth more than £10,000, subject to a maximum fee capped at £10,000. This statement has been met with widespread condemnation from the legal sector. The Civil Justice Council has calculated that that a claim worth £200,000 would cost at 6 times more in court fees under the new proposals than it would under the current regime. Man Killed In Quincy Bar Fight

According to a recent news report from Boston.com, a 42-year-old man died after he was allegedly attacked at a bar in Quincy, Massachusetts. Authorities say defendant attacked victim in the bar, for reasons which have not yet been released, and left him there to die with serious bodily injuries, which is how first responders found him when they arrived at the scene of the alleged attack. Norfolk County prosecutors say they have charged defendant with murder, assault and battery with a dangerous weapon and assault and battery causing serious bodily injury. Prosecutors also say this alleged assault was entirely without provocation, and defendant is being held without bond in the Norfolk County jail to await trial. Daycare Employer Arrested for Allegedly Tying Up Children

According to a recent story from KYTX News, a woman in Spring, TX was arrested for allegedly tying up two children in the classroom in which she worked. Authorities are reporting defendant was charged with unlawful restraining and injury to a child following the conclusion of their investigation. The authorities first became aware of a problem when two witnesses allegedly told police officers that they saw defendant tying up and injuring children while in her classroom at the daycare facility. It should be noted, these two witnesses were said to be referring to two separate incidents they apparently observed. Non-Profit Camp for Traumatic Brain Injury Survivors

Head injures are among the most serious types of personal injuries suffered. Those who are fortunate to survive a traumatic brain injury may be left dealing with physical and mental disabilities, which may affect them for the rest of their lives. Burlington, Mass. Daycare Provider Charged in Murder of Child

In yet another recent example of a tragic injury occurring to child by a daycare provider, Wicked Local Burlington reports the operator of an unlicensed daycare facility near Woburn was recently charged in connection with the death of a child in her care, which occurred last year. Authorities say approximately one year ago, a mother left her six-month-old daughter with a neighbor who regularly provided daycare services for families in the area at her home. Later that afternoon, defendant called mother and informed her that her daughter had stopped breathing. When mother arrived, she saw defendant performing CPR on the child, who was still lying still and non-responsive. Mother quickly called 911. Defendant told first responders baby was unresponsive after she vomited following being fed.

Brady v. Urbas: Informed Consent in Medical Malpractice Cases

Brady v. Urbas, a case from the Pennsylvania Supreme Court, involved plaintiff who suffered from long-term foot problems. Her foot issues were due to toe deformities. Plaintiff had been going to the same podiatrist for years, and he was successfully able to perform surgical procedures to treat the problems with her left foot. At this point, he continued to treat the deformed toes on her right foot. Plaintiff’s primary problem on her right foot was a medical condition known by doctors and patients as hammertoe. Hammertoe in her second toe caused her middle toe to rise, so it was sitting above the natural plane of the sole of her foot. This made it extremely painful when wearing shoes.

May is Bicycle Safety Month

May is Bicycle Safety Month The National Highway Traffic Safety Administration (NHTSA) is getting ready to focus on bicycle safety. Since May is Bicycle Safety Month, they’re encouraging riders and drivers to be “Roll Models.” Anybody can be a “Roll Model,” and all it means is that you’re focused on being a safe rider or driver and you’re setting an example for others. Officials with the NHTSA are hoping that the “Roll Model” program will help to decrease the risks of traffic crashes and preventable injuries and deaths associated with bicycles each year, and although May is Bicycle Safety Month, cyclists and drivers are encouraged to practice bicycle safety every day of the year. Daycare Operator Charged in Shaken Baby Case

According to a recent news article from the Washington Post, the operator of a daycare facility has been arrested and charged in connection with what is believed to be a shaken baby injury to a nine-month-old child. Witnesses say victim dropped her daughter off at the daycare center before going to work. Later that afternoon, daycare owner called 911. When first responders arrived, daycare owner allegedly told EMTs she gave the baby her bottle and placed her in a swing. She said the baby started to cry, but quickly stopped, so she assumed infant had fallen asleep. She went to answer a knock at the front door, and when she returned a few minutes later, the child wasn’t breathing. At this point, she told EMTs she …

Hodson v. Taylor, a case from the Supreme Court of Nebraska, involved plaintiff who was injured in a lake accident. Plaintiff and group of friends were invited to lake house owned by the parents of a member of group. All members of the group were around 18 at the time of the accident. The family owned a pontoon boat, which the teens took out on the lake. The teens had each consumed several beers and would drive the boat to a location where they would jump into the water several times and swim around. Mother and Son Killed in Separate Wrecks

Mother and Son Killed in Separate Wrecks Over the weekend, a mother and son died in separate wrecks in northern San Luis Obispo County. According to the San Luis Obispo Tribune, 56-year-old Donna Dean Magee of Templeton died on Saturday afternoon following a one-vehicle truck crash on Highway 58 in Creston. Just 16 hours later, her son, 35-year-old Zackariah Lopez, was killed in a motorcycle crash in Atascadero. A passenger in Magee’s truck was also hospitalized in the crash. The motorcycle crash happened on the 6800 block of Sycamore. At this time, there’s no word on how or why either of these wrecks occurred.
