Yesterday, Mr Justice Coulson delivered an extensive judgment in the case of Cassley and Others v GMP Securities Europe LLP & Sundance Resources Limited [2015] EWHC 722 (QB), in which he dismissed the claim for damages brought by the estate of the Deceased (James Cassley) against his employer (GMP) and its client (Sundance), an Australian mining company, who chartered the ill-fated flight. This case was heard only weeks after the decision in Dusek v Stormharbour Securities LLP [2015] EWHC 37 (QB) in which an employer was found to be liable for the death of its employee on facts that were superficially similar to the present. Fatal I-5 Crash
Fatal I-5 Crash Early Sunday morning, a crash on Interstate 5 took the life of one person and seriously injured another. According to NBC San Diego Channel Seven News, the collision happened sometime around 4:30 a.m., near the Aliso Creek rest area. Initial reports indicate that two people were in the vehicle when it rolled. The surviving victim was airlifted to a local hospital for treatment of life-threatening injuries. At this time, there’s no word on that person’s current condition or the extent if injuries involved. Very few details about this crash have been released. 101 Injury Crash
101 Injury Crash On Saturday, at least one person was injured in a rollover crash on Highway 101. According to Santa Barbara’s Noozhawk, the wreck was reported at 11:24 a.m. For currently unknown reasons, a northbound vehicle overturned on the roadway. The vehicle actually came to rest in a southbound lane of Highway 101. This apparent one-car rollover crash happened just south of Gaviota Tunnel. Crews were swiftly on the scene were multiple drivers were pulled over to offer help. An injured victim was transported to Santa Barbara Cottage Hospital for treatment of moderate injuries. At this time, we do not know that person’s current condition. There is also no word on the cause of the crash, which is likely still under investigation with authorities.
Young Children Suffered Burn Injuries at Amusement Park
According to a recent news article from IJReview, a family was at an amusement park in Phoenix, Arizona when their two children were injured on a boat ride. The two boys were riding bumper boats when their boat broke down. A park employee attempted to restart the boat’s motor, when the gas tank burst into flames, and a massive fireball erupted from the engine, causing the two boys to suffer second-degree burns. Park managers have a released a statement expressing their condolences to the family for any pain and suffering experienced by the child and said they are investigating why the fire occurred and are speaking with the ride’s manufacturers about what went wrong with the boats.

Fatal Mission Bay Crash A crash in Mission Bay took the life of one person on Monday night. According to NBC San Diego Channel Seven News, the one-car wreck happened at about 8:30 p.m. on Sunset Cliffs Boulevard and Ingraham Street. For currently unknown reasons, the Toyota sedan flipped off of the overpass and landed on its roof. At this time, the identity of the driver hasn’t been released. The only witnesses to the wreck were two law enforcement officers who happened to be on the scene assisting another motorist. They were able to partially capture the wreck on body cameras, but the footage hasn’t been released. Costs Budgeting – Time for change
Having at first hand experienced the heated battle of CCMCs, in which costs draftsmen and (usually) junior Counsel joust in front of a Master on the level of costs incurred thus far and those yet to come, it seems that change might be in the air. Lord Justice Jackson is preparing a speech / paper on costs budgeting, to be finalised by mid-May. Fee increase to take place next Monday
A dramatic hike in court fees is to take place on Monday 9th March 2015. The Law Society has published the following table (see below) of the new court fees suggesting solicitors consider issuing cases this week. Employment Tribunal fees were increased in July 2013 and the effect is thought to have been to reduce the number of tribunal claims substantially. It remains to be seen whether the increase of court fees will have the same effect. The move will inevitably raise questions as to whether access to justice is being made more difficult. It may also sharpen the debate about whether our legal system should be funded by society as a whole or simply by its users: is the civil justice system simply about settling disputes between individuals…
New 20mph traffic zones to be trialled in London
Transport for London has announced plans to trial new 20 mph zones in London in an effort to reduce accidents and casualties on London’s streets. The pilot is to start with Commercial Street in Tower Hamlets in April, but is expected to be widened to areas including the A10, the “Shoreditch Triangle”, with TfL also looking at Upper Street and Holloway Road, Westminster Bridge, Stamford Street and Southwark Street, Brixton Town Centre, Clapham High Street, Earls Court Road, Kings Cross Road and Farringdon Road, and Camden Street. Unlicensed Child Care Provider Charged in Child Death
According to a recent report from Fox News, a judge has issued a warrant for the arrest of woman who ran an unlicensed childcare center in Indiana. While defendant did not have a license to run a daycare facility, it was within state law, because she was watching fewer than five children at a time. Authorities allege defendant battered a child to death and then tried to cover his death up by claiming the child choked to death. The young victim was 19 months old at the time of his death. Prosecutors say this is not the first time defendant has had issues with the law. In 2006, she was charged with neglect of a child in her care.
